Data Processing Addendum

This Addendum is part of the Terms of Use between Luxury Moving Solutions LLC ("we") and the moving company using the App ("you"). It applies only to personal information we process for you through AI Photo Scan. Everything else in the App stays on your devices, and we do not receive it. It is optional: it applies to any customer covered by a state privacy law (for example, the Colorado Privacy Act or the California Consumer Privacy Act) who accepts the Terms of Use.

1. Roles. You are the controller (or "business"); we are your processor (or "service provider"). We process personal information only to provide AI Photo Scan, following your instructions as given by your use of the App.
2. What we process. Room photos you choose to scan, and anything visible in them; the room name; your item list; your access code and device ID. We do not receive client names, addresses or phone numbers from the App.
3. No selling or sharing. We do not sell or share this information, use it for our own purposes, combine it with other data, or use it to train AI. We keep no copy of photos or results.
4. Confidentiality and security. Only people who need access to run the service have it, under a duty of confidentiality. Data is encrypted in transit.
5. Subprocessor. We use Anthropic, PBC (Claude API) to analyze photos under its commercial terms, which bar training on this data and provide for deletion within 30 days, subject to limited exceptions. We will give 30 days' notice in the App before adding or replacing a subprocessor; you may object by canceling.
6. Assistance. We will help you respond to consumer requests and data protection assessments to the extent we hold relevant information (in practice, very little, because we keep no photos).
7. Incidents. We will notify you without undue delay, and in any case within 72 hours, after confirming a security incident affecting this information.
8. Deletion. At the end of the service we hold no photos or results to delete or return. Usage counts and acceptance records are kept as long as needed for billing and our legal obligations.
9. Audits. On reasonable request, no more than once a year, we will provide written information showing that we comply with this Addendum.
10. Order of precedence. If this Addendum conflicts with the Terms on personal information, this Addendum controls.
